Problem questions: IRAC done properly

Most law students know IRAC. Far fewer allocate their words correctly within it, and that allocation is most of the difference between a 2:2 and a First.

  1. Issue — one or two sentences. Identify the legal question precisely. Missing an issue entirely is the most expensive error available to you.
  2. Rule — around 30% of the answer. State the law with authority: statute by section, cases by proper citation, and the ratio rather than the facts.
  3. Application — around 50%. This is the marks. Apply the rule to these facts, address the ambiguity, and argue both sides where the law is genuinely unsettled.
  4. Conclusion — brief and decisive. Advise the party. Hedging to avoid being wrong is marked as an inability to advise.

OSCOLA, and why it is unforgiving

OSCOLA uses footnotes and no in-text citation, has no full stops in most abbreviations, and imposes a strict hierarchy of law reports. A law marker spots an OSCOLA error immediately because they read it every day.

  • Cases — neutral citation first where one exists, then the best report. The order runs: official Law Reports, then Weekly Law Reports, then All England Reports.
  • Statutes — short title and year, then the section and subsection, with no comma before the year.
